1. Agreement to Terms

In consideration of Chase Wealth Australia Pty Ltd (ABN 52 618 021 462) (Chase Wealth) allowing you to access and use this site, and by continuing to use this site, you agree to be bound by the terms and conditions set out in clauses 2 – 10 hereafter.

2. Information Purposes Only

This site has been prepared for information purposes only by Chase Wealth without taking account of any particular investor’s objectives, financial situation, or needs.

3. General Guide Only

The site is intended as a general guide only and should not be relied upon to determine the investment objectives, financial situation or individual needs of any person. No part of this website constitutes financial or investment advice.

4. No Investment Offer

This site does not constitute an offer for the issue, sale or purchase of any interest in property or any recommendation in relation to investing in any property. Chase Wealth recommends investors seek professional financial, legal and/or taxation advice before making any investment.

5. Not a Product Disclosure Statement

This website is not intended to be and does not constitute a product disclosure statement or disclosure document as those terms are defined in the Corporations Act 2001 (Cth), nor does this site advertise or promote any kind of managed investment scheme.

6. No Warranty

While every care has been taken in the preparation of this site, Chase Wealth does not make any representation or warranty as to the accuracy or completeness of any statement in it, including without limitation any forecasts or opinions, and persons viewing this site should conduct their own inquiries and investigations.

9. Terms of Engagement

Chase Wealth offers to incorporate the following terms in this clause 9 (Terms), at your request, into any binding agreement between you and Chase Wealth for the provision of property portfolio advisory services to you by Chase Wealth (Engagement):

  1. you may accept the offer from Chase Wealth to incorporate the Terms into any Engagement (in addition to any standard or other terms of the Engagement) by referring to the advertisement on this page (or its content or substance) and requesting services from Chase Wealth on that basis;
  2. if you accept the offer from Chase Wealth to incorporate the Terms into any Engagement, you agree to be bound by the Terms;
  3. in providing services to you pursuant to an Engagement, Chase Wealth will exercise its best efforts, professional expertise, and industry knowledge to identify and recommend investment properties which appear to Chase Wealth to be capable of providing a return on investment of 12% – 18% within 12 months from the date the property is purchased (Best Endeavours);
  4. the Best Endeavours are not a guarantee or promise to achieve a return of any percentage and do not constitute a representation or warranty that a return of 12% – 18% will be achieved. The Best Endeavours are a description of what Chase Wealth will look for in opportunities it intends to present to you;
  5. if Chase Wealth identifies and recommends an investment property pursuant to the Best Endeavours (Recommended Property) and you purchase the Recommended Property, then:
    1. if the Recommended Property is independently valued in the period commencing on the day that is 12 months from the day of settlement on the sale of the Recommended Property to you and concluding on the day that is 18 months from settlement (Valuation); and
    2. the Valuation is for an amount that represents capital growth of less than 12% on the purchase price paid by you for the Recommended Property; and
    3. the Valuation was not, objectively assessed and acting reasonably, affected by any significant downturn in the property market or Australian economy in the 12 months preceding the date of the Valuation,

    Chase Wealth will identify, evaluate and recommend another property investment opportunity for you in accordance with the Best Endeavours without charge, subject to sub-paragraph (f) of these Terms (Complimentary Recommendation);

  6. the Complimentary Recommendation must be requested by you in writing within six months of the Valuation. If you have not requested the Complimentary Recommendation within six months of the date of the Valuation, Chase Wealth will not be obliged to provide the Complimentary Recommendation to you but may do so in its discretion;
  7. you agree that the obligation to provide the Complimentary Recommendation, in accordance with the Terms, will be your sole remedy and is sufficient compensation for any claim by you of a breach of the Terms by Chase Wealth;
  8. to the maximum extent permitted by law, Chase Wealth disclaims all liability for any direct or indirect loss or damage arising out of or in connection with the Best Endeavours or a Recommended Property, howsoever caused, whether by negligence, breach of contract or otherwise;
  9. the Engagement, incorporating the Terms, is governed by the law in force in the State of Victoria and any dispute or difference arising from or in connection with the Engagement (including the Terms) must be referred to arbitration in accordance with the Commercial Arbitration Act 2011 (Vic).

10. Copyright and Intellectual Property

Chase Wealth reserves all rights. No portion of this website or its content may be copied, reproduced, uploaded, posted, or distributed in any form or by any means to another website without the prior written consent of Chase Wealth.
